Property division under protection of a prenuptial agreement

There are certain times in life when it is wise to put aside emotions and be objective. One such time is when considering the pros and cons of signing a prenuptial agreement. While nobody wants to spoil the romance of the wedding, the reality is that many marriages in Illinois end in divorce, and having an agreement that clearly defines property division in such an event might provide both parties with peace of mind.

Many people establish their lives and accumulate assets before they get married. More and more people already own real estate, personal fortunes, thriving businesses and more when they decide to settle down and get married. Then there are those who are remarrying after a divorce. Along with more assets, they may also have additional financial obligations such as child and spousal support, debts and more.

Financial issues can be clearly defined in a prenuptial agreement. It could prevent marital conflict, and a less affluent party might be assured of maintaining a similar lifestyle in the event of a divorce. Knowing that these crucial issues are taken care of can provide the couple the opportunity to live their lives without concern for their welfare if they ever end the marriage.

Illinois couples who have their prenuptial agreements in place would not have to rely on a judge in divorce court to take charge of property division. Money plays a primary part in any marriage, and a prenuptial agreement drafted with professional guidance can avoid contention by laying a firm foundation. Knowing that there will be a secure future for both may provide contentment in the marriage.
